Eligibility

When an uncontested divorce applies

  • Both spouses agree to the divorce — the marriage has broken down irretrievably
  • You have been separated for at least one year (the most common ground under the Divorce Act)
  • There are no outstanding disputes about property, support, or parenting requiring court determination
  • A joint or sole application is appropriate depending on your circumstances
  • The marriage was legally performed in Canada or recognized under Canadian law
