When an uncontested divorce applies
- Both spouses agree to the divorce — the marriage has broken down irretrievably
- You have been separated for at least one year (the most common ground under the Divorce Act)
- There are no outstanding disputes about property, support, or parenting requiring court determination
- A joint or sole application is appropriate depending on your circumstances
- The marriage was legally performed in Canada or recognized under Canadian law
